Ocean Charters Kaua`i Terms & Conditions

Welcome aboard! To provide the best experience for all guests and accommodate limited charter availability on Kauai, please review our policies. By booking a trip with us, you agree to the following terms:

1. 14-Day Cancellation/Reschedule Policy

    • Cancellations by Guest: Cancellations made 14 days or more before the scheduled departure time receive a full refund of any deposit or payment made. Cancellations, no-shows, or late arrivals within 14 days of departure will require payment in full plus taxes.
    • Rescheduling: You may request to reschedule your trip at any time that is 14 days BEFORE departure (subject to availability) with no penalty.  Within 14 days of your scheduled charter, you may still request to reschedule (subject to availability), but if no compatible dates are available, the trip is considered cancelled and subject to payment in full plus taxes.

2. Weather & Ocean Conditions

    • Safety First: Safety is our top priority. If the captain determines that weather or ocean conditions are unsafe, the charter may be canceled or rescheduled.
    • Captain Cancellations: In the event of a captain-initiated cancellation, you will receive your choice of a full refund or rescheduling to another available date.
    • Charter Duration: The indicated length of the charter is subject to change based on ocean conditions and/or the Captain’s discretion.

3. Seasickness & Personal Circumstances

    • Refunds are not provided for seasickness, early returns, changes in travel plans, missed flights, or other personal circumstances occurring within the 14-day cancellation window.

4. Group Bookings & Private Charters

    • Private charters may require a deposit to confirm the reservation. Final guest counts and remaining balances are due 48 hours prior to departure unless otherwise specified by a representative of Ocean Charters Kaua`i.

5. Contact & Modifications

    • To cancel or modify your reservation, please contact us by phone, text, or email as soon as possible.
    • Cancellation timing is based on the scheduled departure time listed on your booking confirmation.

6. Additional Policies & Waivers

    • If not previously reviewed during booking, you may request to read the OCK Catch Policy at any time.
    • If not previously reviewed during booking, you make request to read the OCK Liability Waiver, Release of Claims, Assumption of Risk, and Indemnity Agreement at any time.
    • Upon arrival to your scheduled charter and prior to departure, all participants must accept OCK provided documents by signing in acknowledgment of receipt the OCK “Waiver Signature Page.”
